The information presented on our website or other portals is based on the information provided to us on behalf of the customer. This information is therefore generally non-binding; in particular, we reserve the right to prior sale or rental. We are only liable for incorrect or incomplete information if it is caused by intentional or grossly negligent fault.
If the customer is already aware of the possibility of concluding a contract demonstrated by us, they must notify us of this in writing as soon as possible.
Our claim to a commission always arises when a contract for the property presented or brokered by us (hereinafter simply referred to as the "main contract") is concluded as a result of our information sharing (our details) or our brokerage work. In this case, even mere contributory causation is sufficient. If a main contract is agreed or concluded under modified or different terms and conditions than those we brokered, or if the main contract is concluded with our contractual partner or with another contractual partner for a different property, our commission claim remains unaffected and valid if the main contract is economically almost identical to our information offer or our terms and conditions for the brokerage property.
A claim to commission generally always remains in effect even if a main contract should expire due to a resolutive event. This also applies if a main contract should expire due to the exercise of statutory or contractual rights of withdrawal, provided that this right of withdrawal is exercised for reasons for which the client is responsible. Unless the exercise of this right of avoidance by one of our clients or partners is caused by fraudulent deception or threats to the other contracting parties, we can generally always claim damages.
Our commission claim is always due immediately upon the conclusion of a successful brokerage activity or a main contract. If we have been commissioned by several clients, they are generally jointly and severally liable for the entire commission claim. If commission payment is delayed, default interest of 3.5 percent per annum above the Bundesbank discount rate will automatically be charged.
The commission rates listed below are automatically agreed upon for our brokerage activity or commission.
Single-family homes, terraced houses, individual residential buildings, semi-detached houses, and condominiums: The double commission model applies, whereby the seller and buyer each pay half of 2.38% of the purchase price, including statutory VAT. The total commission is therefore only 4.76% including VAT of the agreed purchase price (see also the buyer-to-buy principle).
Commission for multi-family homes, land, and commercial properties: For the sale of the above-mentioned properties, the brokerage commission is freely negotiable. As a general rule, we charge a buyer's commission of 5.95% (including VAT) of the notarized purchase price. However, special properties can also be negotiated individually.
Rental or leasing of commercial space: 3.0 monthly rent for contracts with a term of up to 5 years 3 percent of the ten-year rental amount for contracts with an agreed term of more than 5 years. An option period counts as part of the agreed term. The currently applicable sales tax is always added to the agreed commission and invoiced.
If the order can no longer be or should no longer be executed, the client must notify us in writing.
If the client intentionally fails to fulfill their contractual obligations, we are entitled to claim damages for the work we have invested.
Should any part of our General Terms and Conditions (GTC) be invalid, the valid parts will continue to apply, and the invalid or legally ineffective parts will be replaced by the applicable statutory provisions.
